Welcome to https://www.ilenecohen.com (the “Site”) provided by PranaSpirit Nutrition & Wellness, LLC (“PranaSpirit” or “we” or “our” or “us”).

This Privacy Policy applies to information collected in connection with access to and use of our Site by visitors, and describes the types of information collected, how we use such information, and how we protect it.

By using this Site or voluntarily providing information to us, you consent to the collection and use of your information by PranaSpirit in accordance with this Privacy Policy.

If you do not agree to this Privacy Policy, you may not use PranaSpirit’s services.

Protected Health Information and HIPAA Compliance

When you, your parent, or your other personal representative shares with us any health related information in order to receive nutrition advice through the Site, such information is likely to be protected health information (“PHI”) subject to the privacy and security safeguards of the Health Insurance Portability and Accountability Act and its regulations (“HIPAA”).

PranaSpirit’s use and disclosure of your PHI is governed by its HIPAA Notice of Privacy Practices, but this Privacy Policy provides additional details regarding how PranaSpirit protects the privacy and security of PHI and personally identifiable information (“PII”) provided through the Site or otherwise.

If you use our other services and do not submit any health-related information that would otherwise be subject to HIPAA (such as a Site visitor who books an appointment for yoga that does not involve any nutrition consulting by us), then the terms of this Privacy Policy will govern our use and disclosure of your PII as detailed in Sections 2, 3, 5 below.

Personally Identifiable Information Collected

We collect PII from you when you submit it to us, including by registering on the Site; completing any forms provided by us; signing up for our services and newsletter; and contacting us via email or otherwise.

Such PII may include, for example, your name, last name, email address, mailing address, billing address, telephone number, and payment method.

We may combine PII we collect from you with information we receive about you from other sources, such as address update services.

Our card processor stores all credit card information. They conduct the entire credit card transaction. We only store a record that the transaction took place. We may collect PII from you when you write a review on our Site.

However, we do not ask, and you should not enter, your full name anywhere in your review. Each time you visit the Site, we may also automatically collect certain types of information about your computer or device, such as your IP address, operating system, browser, domain, and other technical information that may be collected and linked with your PII.

Use of the Information Collected

We may use your PII for any of the following purposes:

  • To book your appointment and provide services to you.
  • To respond to your inquiries.
  • To send you a confirmation email when you book our services.
  • To verify and validate your identity.
  • To review Site usage and operations.
  • To address problems with the Site.
  • To to protect the security or integrity of the Site and our business.
  • To monitor the Site for compliance with our Terms and Conditions and the law.
  • To contact you with Site updates, newsletters and other informational and promotional materials. With respect to PHI, as described in our HIPAA Notice of Privacy Practices.

If you sign up for our mailing list, we will send you informational emails about offers of services.

At any time, you can ‘unsubscribe’ yourself from our email list simply by clicking the ‘unsubscribe’ button.

If you do not wish to receive communications from us about special offers and promotions, you can opt-out of receiving these communications by following the instructions contained in the messages you receive or contacting as detailed in “Contact Us” below.

Even if you opt-out of receiving these messages, we reserve the right to send you certain communications relating to the services we provide, and we may send you service announcements and administrative messages.

We do not offer you the opportunity to opt-out of receiving those communications.

Like many commercial websites, we analyze how visitors use our Site through what is known as “cookie” technology. We may use cookies for different purposes, including for allowing you to use the Site without having to re-enter your user name and password and personalizing your Site usage and shopping experience.

In the event of the sale or transfer of PranaSpirit, of one or more of our business units or of some or all of our assets, or in the context of some other business acquisition transaction.

We will require any such successor business entity to honor the terms of this Privacy Policy.

We may forward your PII to your insurance plan, so that we may handle reimbursement of your prescription purchase for your convenience.

To any other third party with your prior consent to do so.

We may also share aggregate, non-personally identifiable information about Site users with third parties.

Please note that if you voluntarily submit your PII for posting on the Site, such as a review, testimonial or log post, the information becomes publicly available and can be collected and used by others, so you should use care before posting information about yourself online.

Access, Correction, & Deletion

We respect your right to access and correct your PII.

You may access your PII by signing into your account.

From there, you can correct or modify your information. You may also exercise your rights, subject to applicable laws, to request that we delete or restrict access to your PII.

We may need to retain it for legally permitted purposes and this will be explained to you if necessary.

Protecting Children Under Age 13

We understand the importance of protecting children’s privacy in the interactive online world.

The Site is not designed for, or intentionally targeted at, children under 13 years of age.

It is not our policy to intentionally collect or maintain information about anyone under the age of 13.

No one under the age of 13 should submit any PII to us or the Site.

Under Age 18 Minors under 18 years of age may have PII that they have provided to us through the Site deleted by sending an email as detailed in the “Contact Us” section below.

Please note that, while we make reasonable efforts to comply with such requests, deletion of your PII does not ensure complete and comprehensive removal of that data from all systems.

Third Party Websites The Site may contain links to third-party websites, such as social media sites like Facebook and Twitter, which may have privacy policies that differ from our own.

We are not responsible for the activities and practices that take place on these websites.

We take reasonable steps on the Site to help to protect any PII you have provided to us from loss, misuse or alteration.

Do Not Track

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, we do not recognize DNT.

Retention of your PII

We will store your PII for as long as we believe is necessary or appropriate (i) to carry out the purpose(s) for which we collected it, or (ii) to comply with applicable laws, contracts, or other rules or regulations.
